Financial Settlements

The term “financial remedy” refers to the manner in which finances are allocated when a marriage ends or when a civil partnership breaks down.

This area of law is complex and changes frequently. At Brighton & Hove Law we stay abreast of changes in the law so that we can serve our clients better.

Much of our law practice focuses around protecting our clients’ finances at the end of a relationship and ensuring that their future needs are met.

We can assist in complex financial settlements issues involved in high net worth divorce, from tracking down assets to dealing with offshore accounts, trust issues and international property.

Equally we can assist you if the assets in question are minimal – we understand the need to deal with each case individually and for cost proportionality to be borne in mind in all matters.

For some clients an application to the Court may be necessary to protect their position but in many cases it is not the only option now available. At Brighton & Hove Law we aim where possible to avoid expensive protracted litigation.

If you are able to talk together, this is the cheapest and quickest way to reach a settlement.

Often on separation people need help with some issues and mediation is a means of resolving disputes without making an application to the Court.

Sometimes it is not possible initially to obtain an agreed settlement, so Court proceedings are appropriate.

This does not preclude negotiation as any case can settle at any point before a final hearing but once a Court application has been made it imposes a strict timetable on how matters progress.

Working  closely with other experts who specialise in wealth management we ensure that even those clients with modest assets retain as much value as possible from what accumulated during their relationship. Our aim is to achieve the best possible outcome for each client, through effective negotiation, but, if necessary, through litigation.

Whichever method of resolving financial issues is appropriate for you we aim to offer a personal, empathic and cost effective service.
